Judicial review can be used to test the legality of a decision made by a council, government department and many other decision-makers even where there is no right of appeal. Decisions about notification of resource consent applications are an example.
Sally and Madeleine successfully overturned a decision by the Minister for Oceans and Fisheries on setting the total allowable commercial catch for East Coast tarakihi, correcting the approach taken for the last 24 years.
Sally was part of a legal team that went to the Supreme Court to successfully overturn a decision by the Minister of Conservation to downgrade the status of land in the Ruahine Forest Park to allow it to be flooded for the Ruataniwha Water Storage Scheme.
